For starters, I gather that Red Scare wants to sue me for breach of contract, claiming that I was commissioned to provide a production for them. Newsflash: my name's not Ben. That's not a valid contract, and there isn't a shred of genuine contractual evidence. I've literally never even spoken to Cassandra Tse. I don't need to speak to her to know that she's an entitled bitch. In fact, I actively criticised that $40,000 funding decision. I've never agreed to produce it, and that's why they're now trying to claim co-ownership of the screenplay. -
Now, let's examine that claim more closely: I published all the drafts on Facebook with my own name as the sole author. In the six months or so that I spent in pre-production, which concluded with The Big Smoke, nobody ever mentioned co-ownership. I refused to address the 'notes' and I refused to re-draft. In fact, any subsequent drafts that Dave Armstrong may have produced are completely and totally illegal, and represent a serious breach of my IP. I wrote all the words of those initial 4 episodes. VUW and Red Scare must accept that neither them nor the political parties have any legal right to that material, and certainly have no legal right to coerce me into production. - I deliberately closed pre-production before any contracts were signed. The bad guys and their flunkies were very clear that they expected a movie, but they were completely stupid when it came to how to produce a movie. IP rights always come first.
